PAsO Strictly Requires Special Power of Attorney for Data Privacy

In relation to Regional Office Memorandum Circular No. 08-07-2018 of DFA-Bureau of Local Government Finance subjecting the “Issuance of Certified Copy of Tax Declaration to Persons Other than the Owner and/or Authorized Representative”, the Provincial Assessor’s Office (PAsO) of Oriental Mindoro is not allowing issuance of said records to unauthorized third persons. This is also to inform the public that the office is strictly following the Data Privacy Act of 2012. On the other hand, PAsO protects its records and constrain violations regarding one’s privacy pursuant to Section 13 of R.A. No. 10173 and Section 1C, Item No. 2 (n), Chapter 1 of the Manual on Real Property Appraisal and Assessment Operations (MRPAAO) of the Bureau.

Three out of ten clients tend to ask to release their certification requests but records can only be given to authorized representative having his/her SPA in hand. Moreover, in accordance with Section 472 (9) of the Local Government Code of 1991 (LGC), certified true copies of the assessment records can only be given to any interested party or one who would be benefited by the estate, such an heir, or one direct, not merely indirect or contingent.

As a result, property owners and tax payers are benefited. One can assure that information are deemed confidential for the protection of the privacy of persons and certain individuals and dodge possible conflicts.
